The new law provides that the copyright holder will be able to apply to Roskomnadzor to restrict access to the program illegally distributing objects of copyright (related) rights and information on how to get these objects from the network. To be entitled for such claim, the applicant shall have a court decision in legal force.
Now access restriction is possible in relation to any ‘information resource’. At the same time, different approaches to the interpretation of this term exist, which makes difficult for copyright holders to have violating programs blocked. The law clarification will hopefully simplify the issue.
In addition, a special procedure for blocking information violating copyright (related) rights through programs, as well as such programs blocking, will start to be applied from October 2020. The procedure will involve Roskomnadzor who will determine the owner of the program and the person who posted it on the network, as well as the telecom operator, provided the owner of the program and/or the person, that posted it to the network, fail to block the program.
